Article 1: General Provisions

The e-commerce website of Cobofam, a Limited Partnership with its registered office at Opperstraat, 158 in 1770 – Liedekerke, VAT BE 0738748040, RPR Brussels, (hereinafter ‘L’Excentrique’) offers customers the opportunity to purchase products and services from its online store.

These General Terms and Conditions (“Terms”) apply to every order placed by a visitor to this e-commerce website (“Customer”). By placing an order via the online store of L’Excentrique, the Customer must explicitly accept these Terms, thereby agreeing to their applicability, to the exclusion of all other conditions. Additional conditions from the Customer are excluded, unless they have been explicitly accepted in advance, in writing, by L’Excentrique.

Article 2: Price

All stated prices are expressed in EURO, always including VAT and all other taxes or charges the Customer is required to bear.

If delivery, reservation, or administrative costs are charged, this will be stated separately. The costs are calculated on the Order Page of the website based on the Customer’s order.

The price listing applies exclusively to the items as described in words. The accompanying photos are for decorative purposes only and may contain elements that are not included in the price.

Article 3: Offer

Despite the fact that the online catalog and e-commerce website are compiled with the greatest possible care, it is still possible that the information provided is incomplete, contains material errors, or is not up to date. Obvious mistakes or errors in the offer are not binding for L’Excentrique. L’Excentrique is only obliged to ensure the accuracy and completeness of the provided information within the limits of reasonable efforts. L’Excentrique is in no way liable for manifest material errors, typographical, or printing errors.

If the Customer has specific questions regarding sizes, colors, availability, delivery time, or delivery method, we request that the Customer contact our customer service in advance.

The offer is valid as long as stock lasts and can be modified or withdrawn at any time by L’Excentrique. L’Excentrique cannot be held responsible for the unavailability of a product. If an offer has a limited validity period or is subject to conditions, this will be explicitly mentioned in the offer.

Article 4: Online Purchases

The offer from L’Excentrique is available on its Shop Page, which can be found at www.lexcentrique.be. The products from L’Excentrique are briefly described with a clear mention of the price and, where applicable, the contents/quantity of the product. The Customer can choose to add a product to their shopping cart on each product page.

At that moment, the product will be reserved for the Customer for 30 minutes by L’Excentrique. This reservation does not imply any purchase obligation. Services will be reserved for 10 minutes.

Once the desired products have been added to the shopping cart, the Customer can proceed to checkout. To complete the order, they must enter the necessary details and confirm their payment and delivery method.

L’Excentrique will provide a clear overview of the products and any additional costs on the checkout page.

The Customer can choose from the following payment methods:

· via credit card

· via debit card

· via Paypal or via Klarna

L’Excentrique is entitled to refuse an order due to a serious shortcoming of the Customer in relation to orders in which the Customer is involved.

The customer’s order becomes final once it has been confirmed in the checkout screen, even before the actual payment is made.

Article 5: Delivery and Execution of the Agreement

After receiving payment, the Customer will receive an order confirmation from L’Excentrique along with a simplified invoice. If desired, the Customer can request a detailed invoice by sending an email to info@cobofam.be.

The Customer will then receive a Track & Trace code via the provided email address. This serves as the registration of the shipment with the courier company. From that point on, the Customer will be informed at each stage of the shipment’s status.

L’Excentrique processes shipments from Monday to Friday, with same-day dispatch at 16:00. They arrive in 98.50% of cases (as of May 2020) on the next day at the Customer’s location. However, despite great care, delays may occasionally occur.

Products ordered through this webshop are delivered to all countries within the European Union plus Switzerland.

Delivery is carried out by Bpost, PostNL, DHL, UPS, or DPD, depending on the Customer’s location and the current service conditions of the courier company. L’Excentrique may choose other courier services if deemed more suitable for the Customer’s order.

The goods will be delivered to the Customer’s chosen address no later than 30 days after receiving the order. The Customer is responsible for providing the correct address details.

Any visible damage and/or quality defect of an item or any other deficiency upon delivery must be immediately reported by the Customer to info@cobofam.be, and no later than 2 days after receipt.

The risk of loss or damage is transferred to the Customer once they (or a designated third party who is not the carrier) have physically received the goods. However, if the carrier was appointed by the Customer and was not offered as an option by L’Excentrique, the risk is transferred to the Customer upon delivery to the carrier.

Article 6: Retention of Ownership

The delivered items remain the exclusive property of L’Excentrique until full payment has been made by the Customer.

The Customer agrees, if necessary, to inform third parties of L’Excentrique’s ownership rights, for example, in the case that an unpaid item is subject to seizure.

Article 7: Right of Withdrawal

The provisions of this article apply only to Customers who purchase products online as consumers from L’Excentrique.

The Customer has the right to withdraw from the contract within 14 calendar days without providing any reason.

The withdrawal period expires 14 calendar days from the day the Customer or a designated third party (who is not the carrier) physically receives the last item of the order.

To exercise the right of withdrawal, the Customer must inform L’Excentrique via an unambiguous statement (e.g., in writing by post, fax, or email) of their decision to withdraw from the contract. The Customer may use the model withdrawal form available on the website, but this is not mandatory.

“The Customer may complete the model withdrawal form or another clearly formulated statement electronically via our website: . If the Customer uses this option, we will immediately send the Customer a durable data carrier (e.g., by email) with a confirmation of receipt of their withdrawal.”

To meet the withdrawal deadline, the Customer must send their notification regarding the exercise of their right of withdrawal before the withdrawal period expires.

The Customer must return the goods without delay, but in any case no later than 14 calendar days from the day they informed L’Excentrique of their decision to withdraw from the contract. The goods must be returned to L’Excentrique or handed over to a courier appointed by L’Excentrique. The Customer is considered to have returned the goods on time if they are sent back before the 14-day period has expired.

In case of return due to:

  • Damaged and/or incorrect delivery: L’Excentrique will bear the cost of returning the goods.
  • Other reasons for returning reconditioned items (so-called return deals): A fee of €7.95 will be charged to the Customer. The Customer also bears the shipping costs for the original shipment.
  • Incorrect address details provided by the Customer: All actual costs will be charged to the Customer.

The Customer is requested to return the items in their original condition and packaging, including all accessories, documents, and user manuals, with an intact seal.
If the returned product has been depreciated in any way, L’Excentrique reserves the right to hold the Customer liable and claim compensation for any reduction in value caused by the Customer’s use beyond what is necessary to determine the nature, characteristics, and functionality of the goods.

All returned items will be carefully inspected. The general principle is that the consumer may only inspect the item as they would in a physical store. Returned items may be tried on but must not have been used. If an item has depreciated due to use by the Customer, this depreciation will be charged to the Customer.

If the Customer has requested the provision of services to begin during the withdrawal period, they shall pay an amount proportional to what has already been provided at the time they notify us of their decision to withdraw, compared to the full execution of the contract.

If the Customer withdraws from the contract, L’Excentrique will refund all payments received from the Customer, minus any applicable costs, within a maximum of 14 calendar days from the day L’Excentrique is informed of the Customer’s decision to withdraw.
For sales contracts involving goods, L’Excentrique may wait up to 14 days before issuing a refund, either until all goods have been returned or until the Customer has provided proof of having returned the goods, whichever occurs first.

cheapest standard delivery offered by L’Excentrique will not be reimbursed. However, if the order value falls below the free shipping threshold due to withdrawal, for example, if the Customer returns one out of three items, the shipping cost will be deducted from the credit note issued to the Customer.

L’Excentrique will refund the Customer using the same payment method that was used for the original transaction, unless the Customer has expressly agreed otherwise. In any case, the Customer will not be charged any fees for the refund.

Non-acceptance of a delivery does not fall under the return policy.

The Customer cannot exercise the right of withdrawal for:

· Service contracts after the full performance of the service;

· The supply of goods or services whose price is dependent on financial market fluctuations, which L’Excentrique cannot influence and which may occur within the withdrawal period;

· The supply of goods manufactured according to the Customer’s specifications or that are clearly intended for a specific person;

· The supply of goods that deteriorate quickly or have a limited shelf life;

· The supply of sealed goods that are not suitable for return for health protection or hygiene reasons, and where the seal has been broken after delivery;

· The supply of goods that, due to their nature, have been irreversibly mixed with other products after delivery.

· The supply of alcoholic beverages whose price was agreed upon at the conclusion of the sales contract, where delivery can only take place after 30 days, and whose actual value depends on market fluctuations that the company cannot influence;

· Contracts where the Customer has specifically requested L’Excentrique to visit them to perform urgent repairs or maintenance;

· The supply of sealed audio or video recordings and sealed computer software, where the seal has been broken after delivery;

· The supply of newspapers, periodicals, or magazines, except for subscription agreements for such publications;

· Contracts concluded during a public auction;

· The provision of accommodation other than for residential purposes, goods transport, car rental services, catering, and leisure-related services, where the contract specifies a particular date or period of execution;

· Contracts for betting and lottery services

Article 8: Warranty

Under the law of September 21, 2004, concerning consumer protection in the sale of consumer goods, the consumer has statutory rights. This statutory warranty applies from the date of delivery to the first owner. Any commercial warranty does not affect these statutory rights.

To make a warranty claim, the Customer must be able to provide proof of purchase. Customers are advised to retain the original packaging of the goods.

For items purchased online and delivered to the Customer’s home, the Customer must contact L’Excentrique customer service and return the item at their own expense to L’Excentrique.

If a defect is found, the Customer must inform L’Excentrique as soon as possible. In any case, the defect must be reported within 2 days of its discovery by the Customer. After this period, the right to repair or replacement expires.

The (commercial and/or statutory) warranty does not apply to defects resulting from accidents, neglect, drops, use of the item contrary to its intended purpose, failure to follow the instructions or manual, modifications to the item, improper handling, poor maintenance, or any other abnormal or incorrect use.

Defects that appear after a period of 6 months following the date of purchase or, if applicable, delivery, are presumed to be caused by misuse, unless the Customer provides evidence to the contrary.

Article 10: Penalties for Non-Payment

Without prejudice to the exercise of other rights available to L’Excentrique, in the event of non-payment or late payment, the Customer shall, by law and without prior notice, owe an interest of 10% per year on the unpaid amount from the date of default. Additionally, the Customer shall owe a fixed compensation fee of 10% on the outstanding amount, with a minimum of €25 per invoice, by law and without prior notice.

Without prejudice to the above, L’Excentrique reserves the right to reclaim unpaid (or partially paid) goods.

Article 11: Privacy

The data controller, Cobofam GCV, complies with the Belgian law of December 8, 1992, regarding the protection of privacy in the processing of personal data.

The personal data you provide will only be used for the following purposes:
The delivery of goods and support of the ordering process.
You will only receive promotional messages from L’Excentrique upon your explicit request.

You have the legal right to access and correct your personal data. Upon proof of identity (copy of ID card), you may request, via a written, dated, and signed request, to Cobofam GCV, Opperstraat 158, 1770 Liedekerke, Belgium, or via info@cobofam.be, to receive a free copy of your personal data. If necessary, you may also request that incorrect, incomplete, or irrelevant data be corrected.

We treat your data as confidential information and will not share, rent, or sell it to third parties.

The Customer is responsible for keeping their login credentials confidential and for the use of their password. Your password is stored in an encrypted format, and L’Excentrique has no access to it.

L’Excentrique keeps online (anonymous) visitor statistics to monitor which pages of the website are being visited.

Article 12: Use of Cookies

During a visit to the site, cookies may be placed on your computer’s hard drive. A cookie is a text file created by a website server and stored in your browser or on your mobile device when you visit a website. Cookies cannot be used to identify individuals, only to recognize a device.

L’Excentrique uses First Party & Third Party Cookies on its website to provide an optimal customer experience.

‘First Party Cookies’ are technical cookies used by the website itself to ensure optimal functionality.

Article 13: Partial Nullity – Non-Waiver

If any provision of these Terms is declared invalid, unlawful, or null, this shall not in any way affect the validity, legality, and applicability of the other provisions.

Failure by L’Excentrique at any time to enforce any of the rights set out in these Terms, or to exercise any right, shall never be considered a waiver of such rights, and shall not affect the validity of these rights.

Article 14: Amendments to the Terms

These Terms may be supplemented by other conditions explicitly referred to, including the general sales conditions of L’Excentrique.
In case of contradictions, the present Terms shall prevail.

Article 15: Proof

The Customer acknowledges that electronic communications and backups can serve as legal evidence.

L’Excentrique has subscribed to the Regulations of the UNIZO e-commerce label. A copy of these Regulations and access to UNIZO’s complaints procedure is available at https://www.unizo.be/uw-webshop-juridisch-waterdicht-dankzij-het-unizo-e-commercelabel.

Article 16: Applicable Law – Disputes

Belgian law applies, except for the provisions of international private law concerning applicable law.

The courts of the Consumer’s place of residence have jurisdiction in judicial disputes.The consumer can also turn to the ODR platform (http://ec.europa.eu/consumers/odr/).

L’Excentrique has endorsed the UNIZO e-commerce label regulations. These regulations are available at https://www.unizo.be/ uw-webshop-juridisch-waterdicht-dankzij-het-unizo-e-commerce-label, where complaints or disputes can also be settled out of court via the UNIZO complaint procedure.

Article 17: Reservations for Services, Modifications, and Cancellations

The Customer can schedule an appointment for one or more salon services online at www.lexcentrique.be, via Facebook, or by phone.

A reservation is only final after confirmation by L’Excentrique.

Once confirmed, an appointment can only be canceled or modified under exceptional circumstances. This is possible up to 48 hours before the original appointment, either via the online platform or by email, but not by phone.

If an appointment is canceled or modified less than 48 hours before the original start time, the requesting party is obliged to compensate the other party 100% of the reservation amount (excluding discount vouchers).

An appointment can only be modified once. Further non-compliance with the appointment will immediately result in the compensation mentioned above.

If no cancellation or modification is communicated before the time of the appointment (so-called no-show), the compensation will be increased by 50%, meaning 150% of the reservation amount (excluding discount vouchers).

The Customer may always send a replacement, free of charge, for the appointment without affecting their payment obligation

The Customer is expected to arrive 10 minutes before their scheduled appointment.
If late arrival (up to 15 minutes after the reservation time), the treatment may still proceed, but its duration will be shortened accordingly.
After 15 minutes, the reservation will be considered a “no-show”, with the above-mentioned rules applying.
